United States v. Rahimi involves a second amendment challenge to a restriction on firearm possession in the course of a protection order. 144 S. Ct. 1889 (2024). Rahimi met his girlfriend, C.M., the mother of his child, for lunch. They argued and Mother attempted to leave. Rahimi pushed her into a vehicle causing her head to hit the dashboard. Rahimi took a gun from under the seat and fired as he left. Rahimi later warned Mother that he would shoot her if she reported the incident.
Mother obtained a restraining order against Rahimi and the court suspended Rahimi’s gun license for two years. Rahimi violated the restraining order. When police subsequently searched his home and found a pistol, a rifle, and ammunition, he was found guilty of possessing a firearm in violation of the restraining order. Rahimi challenged the firearms restriction as violating the Second Amendment of the United States Constitution. The United States Supreme Court heard the case due to the constitutional nature of the issue.
The Supreme Court upheld the restriction and found a firearms restriction to be constitutional when an individual poses a credible threat to the physical safety of another. The Supreme Court held that the right to bear arms is a fundamental right, but not unlimited.
